You are responsible for protecting your login credentials and taking reasonable steps to prevent unauthorised access to your account. You must promptly notify HIFIREELS if you suspect that your account has been compromised.

You must not sell, rent, transfer or misuse your account, bypass security controls, create fraudulent accounts or interfere with another user's access to the Platform.

HIFIREELS may take reasonable measures to verify accounts, maintain security, prevent fraud and enforce these Terms.

4. Nature and Availability of the Platform

The Platform may include content-discovery tools, content-sharing facilities, real-time interactive features, communication facilities, creative tools and other digital functionalities.

The availability of a particular feature, content item or functionality is not guaranteed. Additional requirements or separate terms may apply to specific features where appropriate.

5. User-Generated Content and User Responsibility

“User Content” means any material submitted, uploaded, recorded, created, published, transmitted or otherwise made available by a user through the Platform. It includes videos, photographs, images, audio, music, text, comments, captions, profile information, broadcasts and other digital material.

You remain responsible for the User Content you submit or make available. You represent that you own the necessary rights or have obtained all permissions, licences, consents and legal authorisations required for the content and its intended use.

HIFIREELS may review, restrict, remove or disable access to User Content in accordance with these Terms, applicable law and its content-moderation policies.

Content submitted by users does not necessarily represent the views, opinions or endorsement of HIFIREELS.

6. Prohibited Content and Conduct

This list is not exhaustive. HIFIREELS may take appropriate action against other conduct that violates applicable law or these Terms.

7. Copyright and Intellectual Property

7.1 Ownership

You retain ownership of the intellectual-property rights you hold in your original User Content. Uploading content does not automatically transfer ownership to HIFIREELS.

The Platform, its software, branding, design, logos, interfaces and original materials owned by HIFIREELS are protected by applicable intellectual-property laws. You may not copy, modify, distribute or commercially exploit these materials without appropriate authorisation.

7.2 Licence to HIFIREELS

By submitting User Content, you grant HIFIREELS a non-exclusive, worldwide, royalty-free licence, for the duration reasonably necessary and legally permitted, to host, store, reproduce, process, transcode, technically adapt, display, perform, distribute and make that content available as necessary to operate, maintain, secure, moderate and improve the Platform and provide the features you use.

This licence may include making content available to the audiences and through the sharing or discovery features you select, subject to your settings and the Platform's functionality.

HIFIREELS may use content in Platform-related promotion only to the extent covered by this licence and applicable law. Any separate commercial use requiring additional authorisation must be appropriately authorised.

The licence does not transfer ownership of your original content to HIFIREELS. Any rights not expressly granted remain with the relevant rights holder.

7.3 Third-Party Material

You must not upload or use another person's copyrighted work, trademark, photograph, video, recording, performance or other protected material unless you have the necessary rights or legal permission.

The fact that material is publicly accessible online or available on another platform does not mean that it is free to use.

7.4 Copyright Complaints

A person who believes that material available through HIFIREELS infringes their copyright or other intellectual-property rights may submit a complaint through the designated reporting facility or contact address published by HIFIREELS.

Complaints should identify the relevant material, explain the rights allegedly infringed and include sufficient information to assess the claim.

HIFIREELS may request additional information, restrict access to reported material, notify relevant parties or take other appropriate action in accordance with applicable law.

Repeated or serious infringement may result in content removal, account restrictions, suspension or termination.

8. Music, Audio and Other Media

You are responsible for ensuring that you have the necessary rights and permissions for all music, sound recordings, audio, video clips, images and other material included in content you upload or transmit.

Where HIFIREELS makes licensed audio or other media available through a particular feature, its use is subject to the applicable licence and any communicated restrictions. Availability within the Platform does not automatically grant permission for use outside the Platform or for commercial, advertising or other restricted purposes.

You must comply with applicable restrictions relating to territory, duration, account type, commercial use and other licence conditions.

HIFIREELS may mute, restrict, remove or disable material where necessary to address copyright complaints, enforce licence conditions or comply with applicable law.

9. Photographs, Videos and Information Relating to Other People

Before uploading or sharing a photograph, video, voice recording or other material relating to another person, you must ensure that you have the required permissions, rights and lawful basis.

You must not:

a.Publish private, intimate or sensitive recordings without the necessary consent or lawful authority.
b.Use another person's image, voice, identity or personal information to impersonate, defraud, harass, threaten or mislead others.
c.Record or disclose another person's private activities in violation of their rights or applicable law.
d.Publish altered or manipulated material in a manner that unlawfully harms or exploits another person.
e.Use another person's likeness to imply endorsement or commercial approval without the required authorisation.
f.Upload content involving minors in violation of child-safety requirements or applicable law.

HIFIREELS may assess reports concerning such material and take appropriate action, including restricting or removing the material and limiting the responsible account.

10. User Interactions and Safety

Users may interact with one another through features made available on the Platform.

You must treat other users respectfully and must not use the Platform to harass, threaten, exploit, defraud or unlawfully target another person.

You should exercise caution when interacting with people you do not know. Do not disclose passwords, verification codes, banking credentials or other sensitive information to other users.

You are responsible for the statements, commitments and content you personally submit, subject to applicable law. HIFIREELS does not endorse every statement or representation made by users.

Where available, users may use reporting, blocking or other controls to manage unwanted interactions.

11. Reporting, Complaints and Grievance Redressal

HIFIREELS provides or will maintain appropriate reporting and complaint channels for matters covered by applicable law and its Platform policies.

Users may report suspected violations involving content, accounts, privacy, copyright, safety or other matters relating to the Platform through the available reporting mechanism or the published contact details.

Reports should contain accurate information and sufficient details to identify and assess the issue. Knowingly false or abusive complaints may themselves violate these Terms.

HIFIREELS will review complaints and take appropriate action according to their nature, urgency, available evidence, applicable law and relevant Platform policies.

Where required by applicable law, complaints will be acknowledged and resolved within the applicable time limits. Complaints concerning unlawful content, private or intimate imagery, child safety or other urgent risks will be handled in accordance with the relevant legal requirements.

12. Content Moderation and Enforcement

Depending on the circumstances, HIFIREELS may:

a.Issue warnings or request changes to content.
b.Remove, mute, restrict or disable access to content.
c.Limit access to particular features or interactions.
d.Restrict or suspend an account temporarily or permanently.
e.Terminate accounts involved in serious or repeated violations.
f.Preserve relevant records or cooperate with competent authorities where legally required.

HIFIREELS may prioritise reports involving child safety, credible threats, non-consensual intimate imagery, unlawful activity or other urgent risks.

Moderation may not identify every violation immediately. Nothing in these Terms limits HIFIREELS' obligations under applicable law.

Where required, HIFIREELS will provide relevant notices, reasons or review procedures in accordance with applicable law and Platform policies.

13. Account Suspension and Termination

HIFIREELS may restrict, suspend or terminate an account where reasonably necessary because of a breach of these Terms, suspected fraud, unlawful activity, repeated infringement, security concerns, serious safety risks or a legal requirement.

Where appropriate and legally permitted, users may be given notice or an opportunity to address a violation. Serious or urgent circumstances may require immediate action.

Where required by applicable law or Platform policy, HIFIREELS will provide the relevant notice or appeal mechanism.

Users may discontinue using the Platform and request account deletion in accordance with Clause 15.

Termination does not eliminate obligations or liabilities that arose before termination or provisions that by their nature continue to apply.

14. Privacy and Processing of Personal Data

HIFIREELS processes personal data in accordance with its separate Privacy Policy, applicable permissions and applicable data-protection laws.

Depending on the Platform's actual functionality and your use of it, information processed may include:

a.Account and profile information.
b.Content, captions, media and associated technical metadata that you submit.
c.Usage and interaction information, such as views, follows, likes, reports and feature activity.
d.Technical and diagnostic information, such as device information, app version, logs, crash reports and security signals.
e.Information provided in support requests, complaints and legal correspondence.

The information actually collected depends on the features used, device permissions, technical implementation and applicable legal requirements.

14.1 Purposes of Processing

Subject to applicable law and the Privacy Policy, HIFIREELS may process relevant information to:

a.Create and manage user accounts.
b.Provide, maintain and improve the Platform.

j.Protect the rights, property and security of users and HIFIREELS.

HIFIREELS will process personal data only for lawful purposes and in accordance with applicable requirements concerning notice, consent or other lawful grounds.

14.2 Sharing and Disclosure

HIFIREELS may disclose necessary information to service providers that assist with hosting, storage, technical operations, security, analytics, customer support or other legitimate Platform functions, subject to applicable legal and contractual safeguards.

Information may also be disclosed where required or lawfully requested by competent authorities, or where necessary to address fraud, security incidents, legal claims or serious safety concerns.

Content and profile information that you make public may be visible to other users. You should not upload information that you do not want made available to the intended audience.

HIFIREELS will not sell personal data in a manner prohibited by applicable law. Any advertising, analytics or other data-sharing practices must be accurately disclosed and implemented in accordance with the Privacy Policy, applicable law and relevant user choices.

14.3 Device Permissions

The Platform may request access to device functions such as the camera, microphone, photos or media files when required for features you choose to use.

You may manage permissions through your device settings. Disabling a permission may affect the availability of the corresponding feature.

Location information or other sensitive device information must only be collected where the app actually implements such collection and in accordance with applicable permissions, notices and legal requirements.

14.4 Security

HIFIREELS will implement reasonable security measures appropriate to the information processed and the obligations imposed by applicable law.

No method of electronic transmission or storage can be guaranteed to be completely secure. Users must protect their credentials and promptly report suspected unauthorised access.

Further details are provided in the Privacy Policy.

15. Account Deletion

Users may request deletion of their HIFIREELS account through the account-deletion mechanism made available within the Platform and through the following web-based route:

Account Deletion Webpage: https://hifireels.com/delete-account

Support Email: support@hifireels.com

The process may require reasonable verification to confirm the requester's identity and protect against unauthorised deletion requests.

After a valid deletion request is processed, HIFIREELS will delete or de-identify associated personal data in accordance with applicable law and the Privacy Policy, except for information that must or may lawfully be retained.

Content already copied, downloaded, shared or independently saved by other users may remain outside HIFIREELS' control. Limited records may also remain temporarily in backups or be retained where legally required or permitted for security, fraud prevention, dispute resolution or legal claims.

Account deletion does not automatically remove records that HIFIREELS is legally required to retain. Applicable exceptions and retention periods will be explained in the Privacy Policy.

16. Data Retention

HIFIREELS will retain personal data only for as long as reasonably necessary for the purposes described in the Privacy Policy, subject to applicable legal requirements.

Retention may depend on the type of information, the purpose of processing, account status, security requirements, legal obligations and the need to address complaints or disputes.

Account and profile information may be retained while an account is active and until an applicable deletion process is completed.

User Content may be retained while it remains available on the Platform or while retention is otherwise lawful and necessary.

Technical, diagnostic and security logs may be retained for a defined period appropriate to their purposes.

Information relevant to complaints, fraud investigations, copyright disputes, legal proceedings or statutory obligations may be retained for the period reasonably necessary or legally required.

Backup copies may remain for a limited period under the applicable backup and deletion cycle.

When personal data is no longer required, HIFIREELS will delete it, securely dispose of it or de-identify it as appropriate and as required by law.

The Privacy Policy must describe the actual retention periods or criteria used by HIFIREELS. This clause does not authorise indefinite retention without a lawful basis.

17. Children's Safety

Users must comply with the applicable minimum age requirements and all child-safety rules.

HIFIREELS prohibits the use of the Platform for child sexual exploitation, grooming, abuse or other unlawful harm involving minors.

HIFIREELS may restrict or remove relevant material, suspend accounts and report suspected unlawful activity to competent authorities where required by law.

The Platform must not be used to exploit, endanger or unlawfully target children.

18. Third-Party Services

The Platform may rely on third-party services, software or links. Such services may be governed by their own terms and privacy policies.

HIFIREELS is not responsible for third-party services beyond the responsibilities imposed on it by applicable law.

Your use of a third-party service is subject to its applicable terms and policies.

19. Availability and Changes

HIFIREELS will make reasonable efforts to maintain the Platform but does not guarantee uninterrupted availability, error-free operation or permanent availability of any particular feature or content.

HIFIREELS may update, modify, suspend or discontinue parts of the Platform for operational, security, legal or other legitimate reasons, subject to applicable law and any mandatory user rights.

20. Disclaimers

To the maximum extent permitted by applicable law, the Platform is provided on an “as available” basis.

HIFIREELS does not guarantee the accuracy, completeness, legality or reliability of all User Content and does not endorse every statement or representation made by users.

Nothing in these Terms excludes any liability, consumer protection or statutory right that cannot lawfully be excluded or limited.

21. Limitation of Liability

To the extent permitted by applicable law, HIFIREELS will not be liable for indirect or consequential losses arising from the use of the Platform, third-party conduct or User Content.

This clause does not exclude or limit liability for fraud, wilful misconduct or any other liability that cannot lawfully be excluded or limited under applicable law.

22. Indemnity

To the extent permitted by applicable law, you may be responsible for losses, claims or reasonable expenses arising from your unlawful conduct, infringement of third-party rights or material breach of these Terms.

Nothing in this clause requires you to indemnify HIFIREELS for losses caused by HIFIREELS' own unlawful conduct or transfers any liability that cannot lawfully be transferred.

23. Legal Compliance and Official Requests

Users must comply with applicable laws when accessing and using the Platform.

HIFIREELS may preserve or disclose relevant information in response to lawful requests or binding directions from competent authorities, subject to applicable law and legal safeguards.

HIFIREELS may take reasonable steps to investigate unlawful conduct, protect users and maintain the security and integrity of the Platform.

24. Changes to These Terms

HIFIREELS may update these Terms to reflect changes in the Platform, legal requirements, security practices or operational arrangements.

Updated Terms will be made available through the Platform or another appropriate channel. Where required by law, HIFIREELS will provide notice or obtain consent before changes take effect.

HIFIREELS will review and update relevant disclosures when material changes are made to the Platform or its legal operator.

25. Governing Law and Disputes

These Terms are governed by the laws of India, subject to mandatory legal protections and rights available to users under applicable law.

Disputes will be handled through the remedies and procedures available under applicable law. Nothing in these Terms prevents a user from approaching a competent court, regulator or other forum where legally entitled to do so.

26. Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A failure or delay by HIFIREELS in enforcing a provision does not automatically waive its right to enforce that provision later.

27. Entire Agreement

These Terms, together with the applicable Privacy Policy and any additional terms expressly applicable to a feature, constitute the agreement governing your use of the Platform.

If an additional feature-specific term conflicts with these Terms, the feature-specific term will apply only to the extent of the conflict and where legally permissible.
